FMLA & FAMLI Leave 

Family and Medical Leave Act

The FMLA entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons with continuation of group health insurance coverage under the same terms and conditions as if the employee had not taken leave. Eligible employees are entitled to:

Twelve workweeks of leave in a 12-month period for:
 • the birth of a child and to care for the newborn child within one year of birth;
 • the placement with the employee of a child for adoption or foster care and to care for the newly placed child within one year of placement;
 • to care for the employee’s spouse, child, or parent who has a serious health condition;
 • a serious health condition that makes the employee unable to perform the essential functions of his or her job;
 • any qualifying exigency arising out of the fact that the employee’s spouse, son, daughter, or parent is a covered military member on “covered active duty;” or

Twenty-six work weeks of leave during a single 12-month period to care for a covered servicemember with a serious injury or illness if the eligible employee is the servicemember’s spouse, son, daughter, parent, or next of kin (military caregiver leave).

Family & Medical Leave Insurance

Colorado voters approved the paid Family and Medical Leave Insurance (FAMLI) program in 2020. FAMLI ensures Colorado workers have access to paid leave in order to take care of themselves or their family during life circumstances that pull them away from their jobs, so workers don’t have to choose between earning a paycheck and taking care of their families. When life happens, FAMLI has you covered. 

FAMLI benefits officially became available on January 1, 2024. Covered Colorado workers may receive up to twelve weeks of leave per year to:
 • Bond with a new child, including adopted and fostered children.
 • Care for themselves, if they have a serious health condition.
 • Care for a family member’s serious health condition.
 • Make arrangements for a family member’s military deployment.
 • Address the immediate safety needs and impact of domestic violence and/or sexual assault.

Those who experience pregnancy or childbirth complications may receive an additional four weeks for a total of 16 weeks per year.
Both employers and employees contribute premiums to the program. Premium contributions began in January 2023. Use the FAMLI Premiums & Benefits calculator to estimate the cost of your premiums and your potential benefit payment.

​Claim submissions will be done through UNUM as of July 1, 2025.

​​On the web:
1. Go to unum.com/access.
2. Create or log into your account:
     a. If filing for the first time, click “Create an account.” We
         recommend using a personal email address that is easily
         accessible when away from work.
     b. If you already have an account, enter your email.
3. Once you’re logged in, begin with “Start a Claim or Leave” to provide initial details of what happened.
4. Add claimant information as requested, including:
     a. Your employment information
     b. Medical care resulting from the event, like surgery
     c. Medical providers visited—physicians, hospitals, other medical professionals
5. Review your information and:
     a. Confirm responses
     b. Provide medical authorization
     c. Review fraud statement
6. Select “Accept” and “Submit.”
7. View confirmation screen, see any next tasks and track progress.
